When Can I Evict My Tenant (California Eviction Update August 2020)

As of this writing, the California state-wide stay on eviction proceedings will end as of September 1, 2020. While this seems to be excellent news for landlords, it is important for landlords to be aware of the following information:

  1. It is possible that the state legislature will continue the stay to a later date due to the continuing COVID-19 pandemic.  It is also possible that some conditions may be placed on evictions.
  2. Many cities and counties have enacted their own eviction regulations. Some of these may continue to prohibit evictions, or may require that a landlord give tenants a period of time in which to pay past due rent.
  3. The eviction prohibitions continue to be very fluid and change often, so landlords should be sure that they have the latest information.

We do recommend that landlords attempt to work with otherwise good tenants who have had financial difficulties due to COVID. Landlords may also wish to contact their lenders to see if the lenders may offer some COVID relief to borrowers. If there are any doubts as to the legitimacy of an eviction, please consult an attorney.
